ANSWERS & ADVISORY

Frequently Asked Questions on GST & Taxes (2026)

Common queries answered by KK Startup India Chartered Accountants.

How do I determine whether to charge CGST + SGST or IGST?

The type of GST depends strictly on the Location of Supplier and the Place of Supply:

  • Intra-State Supply (Same State): If the supplier and buyer are in the same state (e.g., Delhi to Delhi), both CGST (Central GST) and SGST (State GST) are charged equally (50% each).
  • Inter-State Supply (Different States): If the supplier and buyer are located in different states (e.g., Delhi to Maharashtra), IGST (Integrated GST) is charged at the full combined rate.
What is the difference between GST Exclusive and GST Inclusive calculations?

GST Exclusive means the quoted price is purely the base value, and GST must be added on top (common in B2B transactions). For example, ₹10,000 + 18% GST = ₹11,800.

GST Inclusive means the quoted price already includes GST (common in retail MRP products). To find the original taxable base price, you divide the MRP by (1 + Rate/100). For ₹11,800 with 18% GST, the base price is ₹10,000, and GST is ₹1,800.

What is the e-invoicing threshold for businesses in India in 2026?

In 2026, e-invoicing is mandatory for all registered businesses whose aggregate turnover exceeded ₹5 Crore in any preceding financial year since FY 2017-18. All B2B and export invoices must be reported on the Invoice Registration Portal (IRP) to generate a valid IRN and QR code before delivery.

Can I claim Input Tax Credit (ITC) if an invoice is not visible in GSTR-2B?

No. Under Section 16(2)(aa) of the CGST Act, 100% strict matching with GSTR-2B is mandatory. If your vendor has not filed their GSTR-1 and the invoice is missing from your GSTR-2B, you cannot claim ITC. Claiming ineligible ITC attracts notice, penalty, and 18% interest under Section 50.

What are the late fees and interest for delayed GST return filing?

Under Section 47, the late fee for filing GSTR-3B after the 20th is ₹50 per day (₹25 CGST + ₹25 SGST) for tax-paying returns, capped according to turnover slabs. For Nil returns, the fee is ₹20 per day. Additionally, Section 50 mandates interest @ 18% per annum on net tax liability paid in cash after the due date.
